Vista Landscaping - Terms and Conditions
1. Introduction
1.1 These Terms and Conditions govern the provision of landscaping, gardening, and related services by Vista Landscaping ("we," "us," "our") to the customer ("you," "your").
1.2 By engaging our services, you agree to be bound by these Terms and Conditions.
2. Services Provided
2.1 Vista Landscaping offers gardening, lawn care, landscaping, maintenance, and other related services as agreed with the customer.
2.2 A written quotation will be provided before commencing work, detailing the scope, cost, and estimated timeline.
2.3 Any additional work beyond the agreed scope must be approved in writing by us and may be subject to additional charges.
3. Quotations and Payment
3.1 Quotations are valid for 30 days from the date of issue.
3.2 A deposit may be required before work commences, depending on the project size.
3.3 Payment is due in full upon completion of the work unless otherwise agreed in writing.
3.4 Late payments may incur interest at 4% per annum above the Bank of England’s base rate.
3.5 Payments can be made via bank transfer, debit/credit card, or other agreed methods.
4. Customer Obligations
4.1 The customer must ensure access to the site during the agreed working hours.
4.2 Any necessary permissions, such as those from landlords or local authorities, must be obtained by the customer before work begins, and the customer bears full responsibility to ensure they have permission for all work they request us to perform.
4.3 The customer must inform us in advance of any underground utilities, pipes, or other hidden obstacles that may be impacted by landscaping work. Failure to disclose such information may result in damage or injury, for which the customer assumes full responsibility.
5. Cancellation and Rescheduling
5.1 If you need to cancel or reschedule a service, you must provide at least 48 hours’ notice.
5.2 Cancellations within 48 hours may be subject to a cancellation fee of up to 25% of the total quoted price.
5.3 If we need to reschedule due to unforeseen circumstances, we will provide as much notice as possible and arrange a suitable alternative date.
6. Liability and Warranties
6.1 We will perform all work with reasonable skill and care and in compliance with UK regulations.
6.2 We are not liable for any damage caused by pre-existing conditions, such as unstable structures or undisclosed underground utilities.
6.3 Any materials or plants supplied by us are subject to availability, and we do not guarantee the survival of plants after installation due to factors beyond our control.
6.4 We shall not be liable for delays or failure to perform services due to weather, supply chain issues, or other unforeseen circumstances beyond our control.
7. Health and Safety
7.1 We comply with all relevant health and safety regulations and will take the necessary precautions to ensure a safe working environment.
7.2 Customers must ensure that pets and children are kept away from the work area during landscaping activities. Adults should also keep a safe distance and not interfere with our work.
8. Complaints and Dispute Resolution
8.1 If you are dissatisfied with our service, please contact us within 7 days of completion to allow us to address any concerns.
8.2 Disputes that cannot be resolved amicably should be referred to mediation before taking legal action.
